The president's order specifically gives Mattis the discretion to take his time, and to recommend something else to Trump, while giving Trump the appearance of a political win to satisfy social conservatives in his base. Until the plan is completed, he said, transgender individuals now serving will not be discharged based on gender identity.

In addition to legislating on LGBT service in 1993, Congress legislates today on almost every aspect of military manpower policy, from recruiting standards to education requirements to the total number of troops each service can have.

"Though Defense Secretary Mattis appears rightly troubled by the president's action, his statements do not change the directive nor has he been given the power to retain transgender service members indefinitely", Strangio said. It directed Mattis to study the issue and determine how to implement Trump's direction.

The memo Trump signed on Friday formally directed the Pentagon to ban transgender individuals from openly serving in the US military and gave the department six months to develop an implementation plan that will go into effect on March 23, 2018.

It's no sure thing, however, that any amendment targeting Trump's transgender directive would get to a vote.
