Dallas Mavericks owner Mark Cuban is denying a 2011 allegation of sexual assault after a weekly alternative newspaper in OR published details of a case that prosecutors didn't pursue, saying they didn't believe there was evidence to support the claim. She alleges that while they posed together, he reached down the back of her trousers and penetrated her vagina with a finger.

Cuban denied the allegations as well by simply saying, "it didn't happen".

The woman, who is now in her 30s and married, briefly spoke with Williamette Week about the incident.

Portland defense attorney Stephen Houze, who represented Cuban during the police investigation, sent the same message Wednesday morning in an email to The Oregonian/OregonLive.

Cuban appeared drunk at the time, the woman told police in 2011, Willamette Week reported. The complainant has also consistently and repeatedly stated to police investigators she does not want to pursue this matter further.

The woman went to police more than a week after the incident, but she immediately told her friend and boyfriend about it. The news broke just two weeks after Sports Illustrated published a report claiming that Cuban's National Basketball Association team had fostered an hostile work environment, rife with misogyny and sexual harassment.

Now, Cuban is facing his own allegation of sexual misconduct-seven years after it first surfaced. Following an investigation, the Multnomah County District's Attorney's Office declined to proceed with the case for lack of evidence, and the alleged victim also decided not to pursue charges.

Prosecutors in OR opted not to pursue the case in which a woman said Cuban reached in her trousers while they were having their picture taken in a Portland nightclub.

Cuban answered "no" to all three questions and the examiner concluded that he was telling the truth, Rees wrote, though the prosecutor acknowledged that polygraph results would not be admissible in court.

Prosecutors wrote that "there is no evidence to corroborate the complainant's statement and there is evidence contradicting the claim".
